1. Acceptance and scope

These Terms of Use (“Terms”) apply to the GuardPoint Advisors, LLC website and online services. By accessing or using this website, you agree to these Terms and our Privacy Policy and Insurance Information Practices Notice. If you use text messaging, our SMS Terms also apply.

If you do not agree, do not use the website. These Terms do not amend any insurance policy, binder, application, carrier agreement, or other written insurance contract.

2. Insurance services and licensing

GuardPoint offers insurance services only where GuardPoint and the individual producer involved are properly licensed and authorized. MN Insurance Agency License #20519205. WI License #8451882.

3. General information only

Website content is provided for general informational purposes. It is not a complete description of any policy, does not account for every person's circumstances, and is not legal, tax, financial, or risk-management advice. Coverage descriptions are summaries only. Actual coverage, exclusions, conditions, limits, endorsements, and duties are controlled by the issued policy and carrier documents.

GuardPoint works to keep website information useful and accurate but does not promise that every item is complete, current, or appropriate for a particular person or business. Speak directly with GuardPoint and review the applicable policy before making an insurance decision.

4. No coverage is bound or changed through the website

Do not rely on an automated acknowledgment, sent-email confirmation, text delivery receipt, or website message as proof that a request was received, accepted, or completed. Contact GuardPoint promptly if you have not received written confirmation.

5. Quotes, applications, and underwriting

A quote is an estimate based on information available at the time and is not a binder or guarantee of coverage or price. Quotes are subject to carrier underwriting, verification, eligibility, available products, final rates, required documentation, and payment.

You are responsible for providing complete and accurate information and promptly correcting any error or omission. Material misrepresentation or failure to disclose requested information may affect price, eligibility, coverage, or a claim. GuardPoint may need a separate authorization before obtaining or disclosing nonpublic personal information; the website privacy notice and these Terms are not that authorization.

6. Claims, urgent requests, and emergencies

If anyone is in immediate danger, call 911. Do not use this website, email, text messaging, or voicemail for an emergency or a request requiring immediate action.

GuardPoint can help you report and navigate a claim, but the insurer makes coverage, investigation, valuation, defense, settlement, and claim-payment decisions under the applicable policy. A message to GuardPoint does not necessarily satisfy a policy's notice requirement. When time matters, contact the insurer's claims line directly and then notify GuardPoint.

7. Electronic communications and SMS

When you contact GuardPoint electronically, you authorize a response through the channel you used or selected, subject to your consent and applicable law. Email and ordinary text messaging may not be secure. Do not send Social Security numbers, driver's-license images, payment-card details, passwords, health information, or other highly sensitive information through those channels unless GuardPoint specifically provides an appropriate secure method.

Text messaging is limited to conversational, quote-related, and customer-service communications and may include personally sent or automated informational messages. GuardPoint does not use the program for promotional or marketing texts. Participation is optional. Review the complete SMS Terms.

8. Acceptable use

You agree not to:

• use the website for an unlawful, fraudulent, abusive, or misleading purpose;
• impersonate another person or submit information without authority;
• attempt to access nonpublic systems, records, accounts, or code;
• introduce malicious code, interfere with website operation, or evade security controls;
• scrape, copy, or use website content in a way that violates law or GuardPoint's rights; or
• submit highly sensitive information through a channel that GuardPoint has identified as unsuitable.

GuardPoint may restrict access or take protective action when reasonably necessary to secure the website, clients, or agency operations.

9. Third-party websites, carriers, and services

The website may link to or use services operated by insurance carriers, communications providers, or other third parties. GuardPoint does not control their content, availability, security, privacy practices, or terms. A link does not imply endorsement, and your use of a third-party service is governed by that provider's agreements and notices.

Carrier forms, portals, billing systems, and claim systems may require separate accounts, authorizations, or terms. GuardPoint is not responsible for a third-party service's independent decisions or acts.

10. Website availability, disclaimers, and liability

The website is provided on an “as available” basis. To the fullest extent permitted by law, GuardPoint disclaims implied warranties relating to the website, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement. GuardPoint does not guarantee uninterrupted, error-free, or completely secure operation.

To the fullest extent permitted by law, GuardPoint will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website, including lost data, lost profits, or business interruption. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits obligations under an insurance policy issued by a carrier.

11. Ownership, governing law, and changes

Website text, design, graphics, branding, and other content are owned by or licensed to GuardPoint and are protected by applicable intellectual-property laws. You may view and print reasonable copies for personal, noncommercial insurance purposes but may not reproduce or distribute the content for another commercial purpose without permission.

Minnesota law governs these Terms, without regard to conflict-of-law rules. Any dispute relating solely to the website or these Terms must be brought in a court of competent jurisdiction in Minnesota, unless applicable law requires otherwise. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.

GuardPoint may update these Terms. The effective date at the top identifies the current version. Continued use after an update means you accept the revised Terms to the extent permitted by law.

12. Accessibility, assistance, and contact

GuardPoint aims to make website information and services reasonably accessible. If you have difficulty using the website or need information in another format, call or email GuardPoint. Requesting assistance will not affect the availability or price of insurance.
